Welcome to BorrowBetter ("BorrowBetter," "we," "us," or "our").

These Terms & Conditions ("Terms") govern your access to and use of BorrowBetter's website, applications, and services (collectively, the "Platform").

By accessing or using the Platform, you ("User," "you") agree to these Terms.

If you do not agree, do not use the Platform.

1. Description of the Platform

BorrowBetter shops loan options on your behalf and recommends the best available option for you based on the information you provide, your circumstances, and responses from participating lenders and lending partners.

We are not a lender.

We do not make credit decisions, and we do not issue loans.

We use the information you provide and the authorizations you give to evaluate available options and connect you with participating lenders and lending partners. You may be directed to a partner website to complete a loan application. Our service does not include every lender or loan product in the market.

2. Eligibility

To use BorrowBetter, you must:

• Be at least 18 years old
• Be a U.S. resident
• Use the Platform for lawful purposes only

We operate in the United States only.

3. Information We Collect

By using our Platform, you acknowledge and agree that BorrowBetter collects a broad range of personally identifiable information (PII) and loan-related data, including but not limited to:

• Contact information (name, email, phone)
• Financial and employment data
• Income information
• Social Security number
• Credit-related information
• Credit report data obtained from consumer reporting agencies
• Device, browser, and behavioral data

You authorize us to collect, access, store, and use this information as described in these Terms and our Privacy Policy.

4. How Your Information Is Used & Shared

BorrowBetter sells or shares your information—only after you provide consent—to vetted lending partners, affiliates, and financial service providers for the purpose of:

• Shopping available loan options, comparing participating partners’ responses, and recommending an option for you
• Delivering your lead information to partners through secure APIs
• Allowing partners to evaluate your eligibility
• Redirecting you to partner websites for full loan applications

Partners may contact you about your request subject to the disclosures, permissions and applicable requirements described in section 9.

Partners operate their own services and are responsible for their own decisions and data practices. Our requirements for sharing information include authorized purposes, applicable confidentiality and security safeguards, and limits on use and onward disclosure.

Please review each partner’s Terms and Privacy Policy before proceeding. Contact support@borrowbetter.com with concerns about information shared through BorrowBetter.

5. No Fees to Users

BorrowBetter is free for consumers.

We earn revenue by receiving affiliate commissions or lead fees from lenders or partners when users interact with their offers.

6. Recommendations; No Guarantees

Our recommendations help you compare options available through participating partners. A recommendation is not a guarantee that an option is the lowest-cost or best product available across the entire market, and it does not replace your own assessment of affordability and the loan’s terms.

We do not guarantee loan approval, a particular rate, a loan amount or other terms. Lending partners make final eligibility, underwriting, pricing and credit decisions.

Review the lender’s final disclosures, rates, fees and repayment obligations before accepting any loan. You decide whether to proceed.

7. User Responsibilities

By using BorrowBetter, you agree that you will:

• Provide accurate and truthful information
• Not use the Platform for fraudulent or unlawful purposes
• Not attempt to access systems or data without authorization

You are solely responsible for verifying any offer or lender before accepting a loan.

8. Partner Websites & Third-Party Links

BorrowBetter may redirect you to third-party websites.

We are not responsible for:

• Content, terms, or policies on third-party sites
• Actions or decisions made by lenders
• Accuracy of information provided by partners

Your interactions with third parties are solely between you and them.

9. Consent to Communication

BorrowBetter and participating partners may contact you about your request through the channels described in the disclosures presented to you. Any marketing calls, texts or other communications that require consent depend on the permissions you provide; requesting loan options does not by itself grant unlimited permission for every party or communication method.

You may withdraw communication consent at any time through any reasonable means, including the opt-out instructions in a message or by contacting support@borrowbetter.com. Our process requires revocation requests to be handled within one business day and communicated to relevant downstream partners. You may also contact a partner directly to manage communications from that partner.

10. Credit Authorization

When a service involves obtaining your credit information, the applicable Credit Authorization Agreement and disclosures presented in that process describe the authorization requested. Merely visiting the Platform does not constitute that authorization.

Credit information is obtained, used and shared only for an applicable permissible purpose and within the scope of required authorization and applicable agreements, including evaluating and matching you with loan options.

For questions about your authorization or to request withdrawal, contact support@borrowbetter.com. Withdrawal applies to future activity as permitted by applicable requirements and does not undo prior lawful processing or required record retention.

11. Intellectual Property

All content, branding, text, graphics, and technology on the Platform are the property of BorrowBetter or its licensors and are protected by applicable intellectual property laws.

Users may not reproduce, distribute, or modify materials without written permission.

12. Disclaimer of Warranties

The Platform is provided "as is" and "as available."

BorrowBetter disclaims all warranties, express or implied, including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness of platform content

We do not guarantee uninterrupted service or error-free functionality.

13. Limitation of Liability

To the fullest extent permitted by law, BorrowBetter is not liable for:

• Any damages resulting from use of the Platform
• Decisions made based on platform content
• Actions of third-party lenders
• Loss of data or unauthorized access
• Financial losses or denied applications

Your sole remedy for dissatisfaction with the Platform is to stop using it.

14. Indemnification

You agree to indemnify and hold BorrowBetter, its officers, employees, affiliates, and partners harmless from any claims, liabilities, damages, or expenses arising from:

• Your use of the Platform
• Your breach of these Terms
• Inaccuracy of information you provide
• Interactions with lenders or partners

15. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflicts of law.

Any disputes must be resolved in state or federal courts located in that state.

16. Changes to These Terms

BorrowBetter may update these Terms at any time.

Updates become effective upon posting, and continued use of the Platform constitutes acceptance of the updated Terms.
